READ OF NSW RENTAL: What are the changes?


The government of the new South Wales has announced that from 19 May its reforms including the end of the evictions of no-groups and more rights for tenants with pets will come into force.

The reforms, announced in October, are the result of so -awaited promises by the subsequent leaders of the work. Following limits on the frequency of the rental increases that entered into force last year, Prime Minister Chris Minns said that the changes will turn to over 2.2 million tenants in the New South Wales. The State also has at least 600,000 owners.

“Today we are making the tenants and owners know that these important changes will start in less than two months,” he said.

“Prohibiting the evictions without land, this will give the tenants the so necessary housing security. This will allow them to make a house a house.”

What are the new rental laws?

From 19 May it will no longer be legal for a landlord to evict a tenant without a valid reason. The longer notice periods for evictions will also apply to certain lease contracts so that the tenants have more time to organize new accommodation after a eviction.

The eviction will have more rights to put an end to a subsequent rental contract previously if they find a new property.

Potential tenants will be able to apply to have a pet in a rental and can only be rejected for specific reasons such as when the type of animal is not normally kept inside, when it would be inhuman or when maintaining the animal it will cause more than reasonable damage.

The approval will be automatically granted if the property owners do not respond to the new standard PET application form within 21 days.

Payment methods of free rentals from commissions such as bank transfers will also be accessible to tenants pursuant to legislation.

How did we get here?

The reforms of the no-group eviction have been promised by several leaders of the work of the new South Wales and are part of the government’s workload since July 2023.

The laws have been approved in October 2024 and include other reforms that entered into force last year, such as preventing owners from increasing the rent more than once a year.

The commissioner for the rental of the new South Wales, Trina Jones, was engaged with over 100 parties concerned, including supporters of tenants, owners of properties and animal assistance groups.

“From the regional roadshow to the round tables in the sector, our team has been meeting on the ground with the parties concerned throughout the new South Wales, keeping 41 sessions of involvement only in this financial exercise to ensure that different items are reflected in the way we communicate and implement these changes,” said Jones.

How will they be applied?

The trading fairing of the new South Wales will apply the rental reforms through its rental task force and $ 8.4 million have been assigned to ensure compliance. Tenants can also be applied to the court if a landlord has an unreasonably retained consensus to have a pet on the property.

When do they start?

The rental reforms will be applicable from 19 May 2025.

Other additions will be introduced by the end of the year, including major privacy protections for tenants and a regime of portable rental bonds.
