The juror was discharged after bringing the knife to court
The judge said that the explanation of the fruit of the juror “could be merit”, the impact of any police investigation would have been a significant distraction and “influenced substantially” on their ability to determine Kanbut’s fault.
The new South Wales police said that the agents were called to the court at 10.50 following reports that a man had been arrested after a knife was detected in the backpack.
“After asking questions, the man was released and no further actions were taken by the police,” said a police spokesman.
On March 24, the judge’s associate advised that he was approached by a male juror while he was out to socialize on Saturday evening, March 22, and reported that he had “addressed her and tried to involve her in a conversation with a certain persistence”.
Bennett said that the jury’s conduct was in “clear violation” of his instructions that the jurors have no contact with the parties involved in the event and have shown a “fundamental” misunderstanding of their function.
The judge said that the interaction did not include observations on the trial, since the opportunity was “reduced” by the clear response of the partner “that they would not have spoken” and his rapid departure from the headquarters.
He said independently of the intention of the juror, “who persisted with his attempts to speak with the partner … by out of doubt that he was not allowed to continue in this role”.
The remaining 10 jurors issued their culprits on April 1st.
Kanbut, who served more than three years of prison sentence before his sentences were canceled on appeal and his new trial was ordered, is on a deposit before the sentence in June.
